Competition Details
Applicants must:
The judges will select entries based on originality, effective use of Adobe Express, overall quality, and business suitability. If the applicant uploads any assets to their entry, they must have the rights to those images or assets for commercial purposes.
The promoter or Adobe may ask permission to access entry source files in order to validate entries. If the applicant fails to provide access within 48 hours of the initial request, they may be disqualified from the competition. Adobe reserves the right to edit entries if it deems this necessary.
If an applicant uses music and/or any footage in their submission, they must obtain the legal rights to do so and be able to provide proof of those rights on request.
An applicant will not be eligible if they are employed by, or related to someone employed by, Adobe or Enterprise Nation.
Competition winners will be in the store space with other winning businesses and have access to branding opportunities. It is the competition winner's responsibility to set up, staff, and stock within the allocated trading space.
Competition winners will be expected to conduct their own marketing activity to attract customers to the store during their trading times.
Competition winners must provide their own payment solutions (i.e. a contactless card reader) to take payment from customers.
Competition winners are expected to arrange all logistics to get their products to the store during the allocated trading time.
Competition winners must provide their own public liability insurance and contents insurance to protect against any theft of, or damage to, stock or products.
Competition winners agree to Adobe using their case study, name, likeness, brand name and related assets forever for global audiences across all media.
Adobe reserves the right to disqualify entries at the judges' discretion.
Adobe reserves the right to create templates including winners brand name(s), logo(s) and image(s) available for global perpetual use within Adobe Express. Winners may be disqualified if assets are not provided within 48 hours of official request.
Winners may be asked to attend an interview with the Adobe team for PR purposes. Winners will be asked for two 15-minute phone interviews and a total of seven hours in-person media time, possibly split across several days.
Adobe may arrange for winners to have professional headshots that it will then use for advertising purposes. If the applicant is not available for this, they must provide alternative images digitally.
Winners may need to provide Adobe with their businesses' advertising materials for promotional purposes.

1.1 We are Enterprise Nation Limited, registered in England and Wales under company number 04676798, whose registered office is at Castle House, Castle Street, Guildford, Surrey GU1 3UW. We are registered for VAT under registration number GB813 1308 72 ("Enterprise Nation", "we", "us", "our").
1.2 These standard terms and conditions and the competition details attached, (together, the "terms") are between Enterprise Nation and you, the individual or business business (the "applicant") that submits an entry to the competition (as defined in the competition details attached).
1.3 These terms set out the rules around, and criteria for entering, the competition (each application to enter being referred to as an "entry").

2.1 All entries must contain all of the information we need, as set out in the competition details. We may not consider, and may automatically disqualify, any entries that do not contain all of this information.
2.2 We will disqualify from the competition any applicant who fails to meet any of the entry criteria, or breaks any of these terms, and consider them ineligible to receive the prize.
2.3 We reserve the right to refuse an entry or refuse to award the prize to any applicant who it has disqualified in line with clause 2.2 and/or who has broken these terms.
2.4 Clause 2.2 will not, however, prevent an applicant from submitting an entry for another competition we run in the future, unless the applicant breaks these terms repeatedly or in a serious way, or for any reason we give otherwise.
2.5 We reserve the right to hold void, cancel, suspend, or amend the promotion of the competition if we need to. If we do change, suspend or cancel the competition, we will, where possible, notify applicants within [seven days] using the contact details the applicants provided in their entry.
2.6 Employees and former employees of Enterprise Nation, and anyone who may be directly associated with the administration of the competition and prize, are not allowed to enter the competition.
2.7 We will share all entries with the competition judging panel (the "panel"). The panel will review entries for the competition and [in conjunction with votes submitted by [external parties]] decide to which winning applicant(s) it will award the prize (the "winner" or "winners").
2.8 Entering this competition does not prevent any applicant applying for another separate competition Enterprise Nation promotes in the future.
2.9 The key dates for the competition, including the opening and closing dates for entries, are as set out in the competition details. Enterprise Nation and the sponsor reserve the right to extend the closing date to a later date. If we do extend the closing date, we will notify applicants via the email address they provided in their entry.
2.10 We must receive all entries by no later than 11:59:59 p.m. (GMT) on the closing date. We will not consider for the prize any entries we receive after the closing date.
2.11 We accept no responsibility for any entry an applicant could not successfully complete because of a technical fault, technical malfunction, failure with computer hardware or software, or any kind of failure with a satellite, network or server.
2.12 If an applicant has any questions about the entry process, they can contact Enterprise Nation at hello@enterprisenation.com.
3.1 The panel will choose the winner(s) of the prize(s) on the decision date. The prize(s) may be open to several winners – if this is the case, the competition details will specify this.
3.2 We will announce the winner(s) of the prize(s) on the Enterprise Nation website on the announcement date. We will notify the winner(s) directly by email (using the contact details provided on the entry) or via their member profile on the Enterprise Nation website.
3.3 Our decision regarding any aspect of the prize or competition is final and binding, and we will not enter into any correspondence about it.
3.4 Subject to clause 3.7, the winner(s) will receive the prize(s), if in cash form, no later than seven days from the announcement date. If the prize(s) are (or are accompanied by) a physical item, the winner(s) will receive the physical item no later than 30 days from the announcement date.
3.5 If the prize is, or is accompanied by, a physical item, the winner cannot exchange or transfer it or receive a cash alternative. If the prize is in cash form, the winner cannot transfer it or exchange it for a physical item.
3.6 If, after having been notified, the selected winner(s) does/do not claim their prize by sending an email to Enterprise Nation, we and the panel will consider them to have rejected the prize, and choose another winner from the runners-up list.
3.7 A third party (the "supplier") may supply the prize. In that case, Enterprise Nation will not be responsible for delivering, or overseeing delivery of, the prize (in whatever form it takes) to the winner(s) and will only be responsible for notifying the winner(s) in line with this clause 3.
3.8 Enterprise Nation must either publish or make available information that indicates that a valid competition took place, and that it awarded a prize to a winner. To comply with this obligation, we will publish the name(s) of the winner(s) – whether an individual or a business – on the Enterprise Nation website. If asked to, we may still need to provide the information contained in the winning entry (or entries) to the Advertising Standards Authority.
3.9 When publishing the name(s) of the winner(s) of the competition on our website, we may also publish the logo(s) of the winner(s) (if this applies), and some or all of the names and/or logo(s) of the other competition applicants. When an applicant submits an entry and accepts these terms, they are granting Enterprise Nation a non-exclusive, non-transferable, revocable licence to use their name(s) and/or logo(s) for this purpose.
3.10 The partner will receive an exclusive, worldwide, royalty-free licence to use, copy, edit or modify the winner's (or winners') materials (the "winner materials") in any and all media, forever. The winner(s) will retain copyright, all moral rights (not including the requirement to name winner(s) on usage) and self-promotion rights. The winner (or winners) grants to the partner the right to use and copy its name in all and any media including via social media, online, via email or text or otherwise. The partner will be assigned the rights to the company materials, but the winner's (or winners') image rights will remain the winner's (or winners') property. For the avoidance of doubt, the winner(s) will retain ownership of all intellectual property rights in the winner materials and the winner's (or winners') image rights.
4.1 Nothing in this agreement will operate to exclude or limit either party's liability for:
4.2 Subject to clause 4.1, Enterprise Nation, its agents or distributors will not in any circumstances be responsible or liable to applicants for any losses arising from their application, nor to the winner(s) for any loss or damage occurring as a result of accepting the prize(s), except where it is caused by the negligence or wilful default of Enterprise Nation, its agents or distributors or its employees. Where applicable, applicants' statutory rights are not affected.
4.3 In any event, subject to clause 4.1 Enterprise Nation's maximum aggregate liability in respect of these terms and the competition will be limited to the value of the prize.
Enterprise Nation will process personal data supplied during the course of the competition only as set out in its privacy policy. See also sections 3.8 and 3.9 with regard to how it shares information.
6.1 Entire agreement. These terms constitute the entire agreement and understanding between the parties in relation to the competition and supersedes any previous agreement or understanding between them in relation to such subject matter.
6.2 Events outside the parties’ control. Enterprise Nation and the sponsor reserve the right to hold void, suspend, or amend the entry process (including these terms) where it becomes necessary to do so for reasons outside Enterprise Nation's or the sponsor's control.
6.3 Waiver. No failure or delay by either party to exercise any right or remedy under these terms shall be construed as a waiver of any other right or remedy.
6.4 Notices. All notices and other communications in relation to these terms will be in writing and deemed to have been duly given if personally delivered, e-mailed, or mailed (first-class postage prepaid) to the address of the relevant party, as referred to above or otherwise notified in writing. If personally delivered or e-mailed, all such communications will be deemed to have been given when received (except that if received on a non-working day or after 5pm on any working day, they will be deemed received on the next working day). If mailed, all such communications will be deemed to have been given and received on the second working day following the mailing.
6.5 No partnership or agency. These terms will not create any partnership or joint venture between Enterprise Nation and an applicant or a winner, or the sponsor and the applicant or Winner, or any relationship of principal and agent, or authorise any party to make or enter into any commitments for or on behalf of the other party.
6.6 Third party rights. These terms do not and are not intended to confer any contractual benefit on any person pursuant to the terms of the Contracts (Rights of Third Parties) Act 1999.
6.7 Governing law and jurisdiction. The competition and awarding of the prize, and any matter arising out of or in connection with these terms, will be governed by English law and applicants of the competition submit to the exclusive jurisdiction of the English courts.
